THE PLANNING AND ZONING COMMISSION OF BENBROOK IS CONDUCTING ITS REGULAR MEETING AT CITY HALL BY TELEPHONE CONFERENCE IN ORDER TO ADVANCE THE PUBLIC HEALTH GOAL OF LIMITING FACE-TO-FACE MEETINGS, ALSO CALLED SOCIAL DISTANCING TO SLOW THE SPREAD OF THE CORONAVIRUS COVID-19.

FOR THIS MEETING, I THE PRESIDING OFFICER AND PHYSICALLY PRESENT IN THE COUNCIL CHAMBERS.

HOWEVER, ALL OTHER MEMBERS OF THE PLANNING AND ZONING COMMISSION ARE PARTICIPATING IN THIS MEETING REMOTELY THROUGH TELEPHONE CONFERENCE, PROVIDING FOR TWO-WAY AUDIO COMMUNICATION FOR EACH MEMBER OF THE PLANNING AND ZONING COMMISSION.

THE NEXT ITEM ON THE AGENDA IS SP DASH 21 DASH ZERO ONE CONSIDERATION OF A SITE PLAN FOR DEVELOPMENT OF A 374 UNIT APARTMENT COMPLEX ON APPROXIMATELY 30 ACRES OF LAND 12.5 DWELLING UNITS PER ACRE.

CURRENTLY ZONED D MULTIPLE FAMILY DISTRICT.

THE SITE IS GENERALLY LOCATED ON THE WEST SIDE OF VISTA.

WAY BETWEEN IH 28 20 FRONTAGE ROAD AND MERCEDES STREET WITH THE HAYES CUMMINGTON SURVEY.

CAN CITY STAFF PLEASE GIVE THEIR PRESENTATION? THANK YOU MR. CHAIR.

UH, ON THE SCREEN BEFORE YOU SLIDE SIX, UH, WE HAVE, UH, AN AERIAL IMAGE OF THE LOCATION OF THE SITE PLAN, UH, AS STATED IN THE, THE, UH, THE ANNOUNCEMENT.

UH, IT'S APPROXIMATELY 30 ACRES OF LAND, UH, LOCATED BETWEEN THE I I 20 FRONTAGE ROAD AND MERCEDES STREET, JUST NORTH AND WEST OF THE, OF THE WALNUT CREEK.

IT'S A 374 UNIT APARTMENT COMPLEX, ALREADY ZONED MULTIPLE FAMILY DISTRICT.

IF WE MOVE TO SLIDE SEVEN, I JUST WANTED TO GIVE A LITTLE BACKGROUND.

UM, SO BACK IN JANUARY, 2021, UH, A PRELIMINARY PLAT WAS BROUGHT FORWARD FOR THE WALNUT CREEK AT, UH, AT BENBROOK, AND THAT WAS APPROVED BY THE PLANNING AND ZONING COMMISSION.

UM, EVEN MORE, UH, A LITTLE TIME AGO DECEMBER IN 2016, THERE WAS A REZONING THAT TOOK CASE, UH, TOOK PLACE, WHICH REZONED THE PROPERTY FROM A D PLAN DEVELOPMENT DISTRICT TO JUST A D DISTRICT, WHICH IS FOR MULTIPLE FAMILY.

UH, SO THE PD, THE PLAN DEVELOPMENT DESIGNATION WAS DROPPED OFF IN THAT ORDINANCE IN 1404, UH, JULY OF 2007, UH, DURING ORDINANCE 1239, THAT'S WHEN THE PROPERTY WAS REZONED TO A MULTIPLE FAMILY PD DISTRICT.

UH, SO JUST TO GIVE SOME CONTEXT OF, UH, OF THE ZONING ON THAT LAND, ON THE NEXT SLIDE, SLIDE EIGHT, UH, WE WANTED TO SHOW JUST SOME OF THE CONCEPT ELEVATIONS.

THIS IS VERY MUCH, UH, WHAT THESE VERY, VERY LIKELY THAT THE BUILDINGS WILL LOOK LIKE THIS.

UM, FINAL DRAWINGS WILL BE SUBMITTED, UH, DURING THE BUILDING PERMIT.

UM, BUT WE WANTED TO JUST GIVE EVERYBODY AN IDEA OF, OF WHAT THESE BUILDINGS WOULD LOOK LIKE, PRIMARILY BRICK AND STUCCO, UH, WITH SOME HARDY BOARD, UM, TYPE THINGS OR TYPE MATERIAL.

ON THE, UH, ON THE WALLS, WE MOVE ON TO SLIDES NINE AND 10.

THIS WILL KIND OF SHOW THE SITE PLAN ITSELF.

UH, I WANTED TO RUN THROUGH JUST A COUPLE POINTS ON THE SITE PLAN.

SO ONE THING THAT WE LOOK FOR IS ACCESS.

UM, DURING THE, THE DEVELOPMENT OF THIS SITE, THERE WILL BE AN EXTENSION TO MERCEDES STREET, UH, WHICH WILL INCLUDE A BRIDGE THAT WILL CROSS THE CREEK, UH, AND IT WILL END IN A CUL-DE-SAC, UM, WHICH COULD CONTINUE TO THE SINGLE FAMILY, UH, PROPERTY TO THE WEST IN THE FUTURE.

BUT THAT IS NOT WHAT'S BEFORE US TODAY.

UH, THE APARTMENT COMPLEX WILL HAVE TWO ACCESS POINTS INTO THE SITE FROM MERCEDES STREET ONCE THE EXTENSION IS COMPLETE.

UH, AND THIS WILL HELP SATISFY THE FIRE LANE, UH, REQUIREMENTS FOR OUR CITY.

UH, THERE WILL BE GATED ACCESS.

UM, THERE ARE APPROXIMATELY, UH, 11 MULTIFAMILY STRUCTURES WITH THE LEASING OFFICE AS WELL.

UM, ON THE SITE, UH, ANOTHER NUMBER THAT IS INTERESTING FOR EVERYONE TO HEAR IS ITS, UH, BILLABLE AREA OF THE SITE.

SO THE BUILDINGS WILL TAKE UP APPROXIMATELY 23% OF THE BUILDABLE AREA, BUT WHEN YOU TAKE INTO THE ACCOUNT THE FLOODPLAIN THAT EXISTS ON THE PROPERTY AS WELL.

UM, IT TAKES UP ROUGHLY 11% OF THE ENTIRE SITE, UM, WHERE THE BUILDINGS ARE.

UM, THERE'LL BE MEETING PARKING REQUIREMENTS, UM, AND THE TRASH RECEPTACLES OBVIOUSLY WILL BE SCREENED WITH MASONRY, UH, AND LOCATED IN APPROPRIATE LOCATIONS,

UH, SO THAT WE DON'T HAVE A BUILDUP OF TRASH AMONG THE RESIDENTS.

ON SLIDE 11, I WANTED TO GIVE A LITTLE BREAKDOWN OF THE MIX OF UNITS.

SO THE BUILDING COMPLEX WILL HAVE APPROXIMATELY 224, UH, ONE BEDROOM UNITS, A HUNDRED AND THIRTY TWO TWO BEDROOM UNITS AND 18 THREE BEDROOM UNITS.

UH, THERE IS NO ZONING REQUIREMENT FOR THIS IN OUR ORDINANCE, BUT, UM, UH, MOST OF THE TIME PEOPLE LIKE TO UNDERSTAND, UH, THE, THE MIX OF UNITS, SO WE WANTED TO MAKE SURE TO BRING THAT UP.

AS FAR AS APARTMENT SIZES, UH, OUR, OUR ZONING ORDINANCE DOES A, REQUIRE A MINIMUM OF 550 SQUARE FEET, UM, WITH AN AVERAGE OF 700.

SO OBVIOUSLY THIS SITE WILL BE EXCEEDING THOSE MINIMUMS. UM, THEIR APARTMENT SIZES WILL RANGE FROM 705 SQUARE FEET TO 1,275, AND THEN THE AVERAGE SIDE SIZE OF ALL THE APARTMENTS WILL BE 884.

UH, SLIDE 12 SHOWS THEIR LANDSCAPE PLAN.

UM, THIS, WE JUST WANTED TO GIVE THE OVERALL, UH, THE OVERALL IMAGE HERE.

THEY, THEIR PLANS DO SHOW THAT THEY WILL SUBSTANTIALLY BE MEETING OUR REQUIREMENTS.

UM, AS LISTED IN OUR STAFF COMMENTS, UH, THEY DO HAVE, UH, UH, SOME AREAS WHERE THEY NEED TO SHOW US EXACTLY HOW MANY OF CERTAIN TYPES OF PLANTS ARE BEING PLANTED, BUT THEY'VE SHOWN NO INDICATION THAT THEY WON'T BE MEETING OUR LANDSCAPE REQUIREMENTS, UM, AND WILL BE VER VERIFYING THAT DURING THE BUILDING CONSTRUCTION DOCUMENTS.

AND THEN ON SLIDE 13, UH, WE ASKED THEM, UH, WITHIN OUR FIRST REVIEW, THE PLAN TO PROVIDE US AN EXHIBIT THAT SHOWCASED WHERE THEY WERE PROVIDING SOME OF THEIR OPEN AREAS, THEIR RECREATIONAL AREAS, UM, THEIR OPEN SPACE.

UH, AS PART OF OUR, UH, DEVELOPMENT REQUIREMENTS, WE DO REQUIRE PARKLAND DEDICATION, UH, AND THAT IS DETERMINED BY HOW MANY DWELLING UNITS ARE ON SITE.

UM, THE ORDINANCE PROVIDES THE OPPORTUNITY FOR THEM TO PROVIDE THEIR OWN PRIVATE PARK AREA, AND THAT IS WHAT THIS EXHIBIT ON SLIDE 13 IS SHOWING.

UH, BECAUSE OF THIS, UH, THEY WILL BE, UH, MEETING THEIR MINIMUM REQUIREMENTS, UH, AND EXCEEDING THE MINIMUM REQUIREMENTS FOR WHAT THEY NEED TO DEDICATE.

UM, THE REMAINDER OF THE LAND, UH, THAT WOULD NEED TO BE CAPTURED IS LESS THAN TWO ACRES.

UH, THE CITY DOES NOT ACCEPT PARKLAND DEDICATION FOR ANYTHING LESS THAN TWO ACRES.

AND SO THE, THE APARTMENT COMPLEX WILL BE REQUIRED TO PAY FOR THE REMAINDER INTO THE CITY'S PARK FUND.

UM, AND THAT TYPICALLY IS CALCULATED AT $600 PER DWELLING UNIT.

UM, THEY, THE PARKLAND DEDICATION THAT THEY ARE PROVIDING ISN'T DEDICATED TO THE CITY, BUT THEY ARE DEDICATING PORTIONS OF THEIR SITE TO THAT.

UM, SO THEY ARE ALLOWED, BECAUSE IT'S PRIVATE PARK, THEY WILL RECEIVE A 50% CREDIT TOWARDS THEIR PARKLAND DEDICATION.

UH, SO, UH, THAT WILL BE COLLECTED, UM, ONCE THE BUILDING PERMIT HAS BEEN APPROVED.

UH, AND THEY'LL BE PAYING FOR THAT AT THE SAME TIME THAT THEY PAY FOR THEIR BUILDING PERMITS.

UH, WITH THAT SAID, UH, AGAIN, STAFF FEELS THAT THE, UH, THE SITE PLAN SHOWS THAT THEY CAN AND WILL BE MEETING, UH, OUR ZONING REGULATIONS.

UH, STAFF DOES ASK THE PLANNING AND ZONING COMMISSION TO MOVE TO APPROVE THEIR SITE PLAN, SUBJECT TO STAFF'S ANALYSIS PROVIDED WITHIN THAT, WITHIN THE STAFF REPORT.

UM, AND IT THE, BECAUSE THERE'S AN APPLICATION IN PLACE NOW, UH, THE CITY CAN'T REZONE THEM.

EVEN IF THEY DID, THEY'D STILL HAVE RIGHTS TO BUILD THE, THE, UH, THE MULTIFAMILY COMPLEX.

UM, SO AS LONG AS THE APPLICANT CONTINUES, THEY HAVE RIGHT TO BUILD THE MULTIFAMILY COMPLEX.

UM, THE CITY ONLY HAS THE ABILITY TO HAVE THEM BUILD THE MINIMUM STANDARDS, UH, WHAT IT LOOKS LIKE.

AND AS FAR AS OUR REVIEW IS, AS THEY'RE, THEY ARE EXCEEDING LOTS OF THOSE MINIMUM STANDARDS, UH, THAT THE CITY HAS.

BUT WE UNFORTUNATELY CANNOT REQUIRE MORE OF THEM THAN MINIMALLY, UH, REQUIRED.

UH, SO WE WILL HOLD THEM TO THOSE STANDARDS, UH, AND WE'LL DISCUSS OPTIONS TO SEE IF WE CAN DO ANY IMPROVEMENTS THAT WE CAN.
